  • In "the Basics of legislation of the USSR and Union republics on health care", approved at the session of the Supreme Soviet of the USSR 19.12.69, stated: "Forensic medical and forensic psychiatric examination is performed in accordance with the legislation of the USSR and Union republics on the decision of the person conducting the inquiry, the investigator, the Prosecutor and on decision of the court. The order of organization and production of forensic medical and forensic psychiatric examination is established by the USSR Ministry of health in coordination with the Supreme Court of the USSR, the USSR Prosecutor's office, Ministry of internal Affairs and other agencies" (article 51).
    On the basis of this law on the basis of prior organizational experience, in accordance with the applicable rules of criminal procedure and civil procedure codes developed and introduced with effect from 21. 07. 78 "instruction on the forensic medical examination".
    This statement was approved by the Ministry of health of the USSR and agreed with the Prosecutor's office of the USSR, the Supreme Court of the USSR, the Ministry of justice of the USSR, Ministry of internal Affairs and the state security Committee under the Council of Ministers of the USSR.
    Simultaneously with this "Statement" approved "Regulations on the Bureau of forensic medical examination", "Position about the head of the Bureau of forensic expertise of the Ministry of health of the Union Republic", "Position about the head of the Bureau of forensic medical examination of the oblast (regional), Republic (ASSR), city (Moscow, Leningrad) subordination", "position about the head of Department Bureau of forensic medical examination", "position about the head of Department of the Bureau of forensic medical examination", "Position about the doctor, medical examiner", "Regulations on methodological the Board of the Bureau of forensic medical examination" and "the provision on the chief medical examiner of the Ministry of health of the USSR".
    In the "Instructions" and "Provisions" are specified: purpose and task of forensic medical examination in the USSR; legislative documents, which determine its functioning; the structure and hierarchy of units examination; General characteristic of the objects within its competence; principles of forensic documentation, regulation of the rights and duties of each unit in the system of forensic examination. Between these units, forensic medical experts and health authorities have organizational, methodological and administrative subordination (scheme 1).

    "Regulations of the Bureau of forensic medical examination" provides that States Bureau approved in established order by the relevant staff regulations and that the Bureau should have the following structural divisions: 1) division of forensic medical examination of the victims, defendants and other persons; 2) the Department of forensic medical examination of the corpses with forensic histology Department; 3) the forensic lab, which consists of forensic Sciences, physical-technical, forensic chemical branch; 4) the district, inter-district and municipal offices of the Bureau of forensic medical examination; 5) the economic part. In the capitals of the Union republics of the district, inter-district and municipal offices are not organized (scheme 2).

    The instruction defines the competence of the forensic medical examination, which includes: 1) examination of the corpses with violent death or suspend it (see Chapter 10); 2) examination of victims, defendants and other persons (see Chapter 38); 3) examination of the evidence by the application of laboratory methods of research objects (see Chapter 43); 4) expertise on medical documents, as well as for criminal and civil cases, when forensic conclusions are based only on data of the medical and forensic medical documents (medical historyambulatory card, protocols or acts mortem, indications of medical workers and witnesses and others).
    When forensic medical examinations (tests and examinations) should be unified organizational basis providing, on the one hand, compliance with the experts of the requirements of legislation and normative documents, and on the other, production expertise with the application of scientific, rational and appropriate methods selected. This basis is operating in the system of forensic examination instructive and methodological guidelines.
